Chapter 13 Trustee

What Exactly Does a Chapter 13 Trustee Do?

Chapter 13 bankruptcy can take anywhere from three to five years to finish paying off your debts before you are able to receive a discharge. During this period, the Chapter 13 trustee will perform an array of duties ranging from ensuring your Plan is compliant with the bankruptcy code to administering the Plan once the court approves it. You will be required to provide information about your monthly income and expenses, along with your debts and assets. Prior to the Meeting of Creditors, you must send the trustee certain documents, including pay stubs and tax returns. The trustee will review the petition and Plan and to determine if the information is accurate, your Plan is feasible, and it complies with Chapter 13.

Our Chapter 13 Trustee Website Can Provide Further Information

If you are filing for bankruptcy our Chapter 13 trustee website along with our expert attorneys can help with your current financial standing. Administering your bankruptcy repayment plan typically includes:

  • Within 30 days of filing, you will have to send monthly payments to the trustee
  • Until the court approves the plan, it lies in a temporary state where the trustee howls the funds
  • Once the plan is approved, the trustee begins distributing funds to creditors
  • It can take 3 – 5 years to finish your Chapter 13
  • The trustee will be charged with receiving your payments and also paying them to creditors
  • The trustee also keeps an accounting of all monies received
  • The trustee will keep track of how much has been paid to each creditor
  • Creditors have to file a proof of claim by a certain deadline which is a statement of the balance claimed
  • The trustee has to review the creditor claims and assure that the Plan adequately provides for curing any defaults and pays those unsecured creditors who are entitled to be paid if you have disposable income to pay them

I have dealt with Matt for a few years for a couple of matters for myself and for my mother-in-law. Matt has always been a man of his word; anything he said he would do was done as expected. He provided timely and accurate advice when requested. Matt never pushed services that were not required and at certain times he recommended less costly services that would achieve the same results. I highly recommend him as very honest and ethical. He always disclosed fees in advance and there were never any "surprise" fees.— jimcar13
Mr Nahrgang was easy to work with, and did an excellent job with my case. Though my case turned out to be more complex than we had originally realized, he handled every complication promptly and competently.— eyedoc89
I was first recommended to Matthew Nahrgang by a friend. I was having serious financial issues at the time. I went to Matt and had a conversation which set my mind at ease. He is straight to the point, honest and tells you how it is. No frills kind of guy. He also is confident in his business and knows the law very well, which is what set me at ease. It was not near a big deal as I thought it to be. He does what he says he is going to do and does it in a timely manner. I have used Matt a few times now and I've recommend him to many of my friends and business acquaintances. I highly recommend Matthew Nahrgang!— my1leelee
In relation to my bankruptcy and in retrospect, I was thankful that I had discovered Mr. Nahrgang and had engaged him to respresent me in my case. I found him to be respectful, understanding, highly knowledgeable and trustworthy. I appreciate all that he did on my behalf and have recommended him to friends and family.— Orangefit09
